1. Acceptance of Terms

Welcome to Find Grow & Keep ("FGK," "we," "us," or "our"). By accessing or using the Find Grow & Keep mobile application (the "App") or our website at www.findgrowandkeep.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Site.

2. Description of Service

Find Grow & Keep is a career development platform designed for technical professionals, engineering leaders, and organizations. The Service provides:

• Personal career development tools: Professional journal, competency tracking, self-assessment, AI-powered career insights, and personality assessments
• Organizational tools: Team and organization management, competency-based hiring, opportunity posting, application review, and team collaboration features (available in Manager tier subscription)
• AI-powered features: Career advice, competency gap analysis, and personalized insights using third-party AI services

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use the Service.

4. Account Registration

4.1 Account Creation

To use certain features of the Service, you must create an account. We use Clerk for authentication. By creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Immediately notify us of any unauthorized use of your account

4.2 Account Security

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

5. Subscriptions and Payments

5.1 Subscription Tiers

Individual Tier ($7.99-11.99/month or equivalent annual):

• Full access to personal career development features
• Professional journal, competency tracking, self-assessment, AI advisor
• Personality assessments and career insights

Manager Tier ($49.99-79.99/year):

• All Individual tier features
• Organization and team management
• Job opportunity posting and application review
• Team collaboration and analytics tools
• Advanced facilitation frameworks

5.2 Payment Processing

• Individual Tier: Purchased through Apple In-App Purchase. Billed through your Apple ID account.
• Manager Tier: May be purchased through Apple In-App Purchase or via our website using Stripe. See specific terms at time of purchase.

5.3 Apple In-App Purchase Terms

If you purchase a subscription via Apple In-App Purchase:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

5.6 Refund Policy

• Apple IAP subscriptions: Refunds are handled by Apple. We do not have access to your Apple payment information. Request refunds through Apple Support.
• Stripe subscriptions: Contact us at support@findgrowandkeep.com for refund requests. Refunds are at our sole discretion and typically pro-rated for the unused portion of annual subscriptions.

• Accuracy Not Guaranteed: While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or outdated information.

11. Disclaimers and Limitations of Liability

11.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FGK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN NO EVENT SHALL FGK'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO FGK IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
